When code can kill or cure – đề cập đến một thực tế là thiết bị y tế ngày càng trở nên phức tạp hơn và được điều khiển bằng phần mềm, chúng ngày càng trở nên giống máy tính và do đó càng dễ xảy ra lỗi phần mềm, gây nên những cái chết/thương tật không đáng có cho bệnh nhân.

Vấn đề ở chỗ đa phần các phần mềm điều khiển thiết bị y tế đều thuộc dạng phần mềm “bản quyền đóng” (dạng như Windows của Microsoft) -> việc thiết kế,cập nhật, sửa lỗi hoàn toàn lệ thuộc vào nhà sản xuất. Và các công ty sản xuất sản phẩm y tế thì không thể so với Microsoft trong lĩnh vực này.

Do đó FDA (Food and Drug Administration – Cơ quan Quản lý Thực phẩm và Dược phẩm Mỹ) hỗ trợ các chương trình/sáng kiến thúc đẩy việc thiết kế và sản xuất các thiết bị y tế sử dụng phần mềm nguồn mở (open source). Mục đích là chuẩn hóa giao thức kết nối các thiết bị và tăng tốc chỉnh sửa, cập nhật lỗi do tất cả mọi người đều có quyền và có thể nghiên cứu mã nguồn mở của hệ thống -> các thiết bị y tế ứng dụng phần mềm nguồn mở sẽ an toàn hơn và có giá thấp hơn.

Tuy hiện nay tất cả các thiết bị y tế sử dụng mã nguồn mở chưa được phép sử dụng trên người bệnh (quy trình xin giấy phép của FDA thường mất vài năm và tốn cả triệu đô la) nhưng xu hướng tiến đến mã nguồn mở là xu hướng tất yếu trong ngành sản xuất thiết bị y tế.
